1. Who these terms cover
These terms apply to this website and to anyone using Hyperis Solar Command Center, Hyperis Solar Pro, Hyperis Solar Connect, Hyperis Field Command or Hyperis Solar Ambassador (the “Services”). A solar company that subscribes to the Services also signs a subscription agreement; if that agreement and these terms conflict, the subscription agreement wins.
2. Accounts
Staff accounts are created by the solar company. Homeowner and ambassador accounts are created through a solar company’s invitation. Keep your sign-in details private and tell the solar company or us right away if you think someone else has used your account. You are responsible for activity under your account.
3. Acceptable use
- Use the Services only for lawful business with homeowners and your team.
- Send texts, calls and emails only to people who have agreed to hear from you, and honor opt-outs.
- Do not try to access another company’s data, probe or disrupt the Services, or copy the software.
- Do not upload content you don’t have the right to use, or anything harmful or misleading.
4. Your data
A solar company owns the data it puts into the Services. We use it only to provide and support the Services, as described in our privacy policy. A company can export its data while its subscription is active.
5. Third-party services
The Services connect to providers you choose to turn on, such as design, accounting, e-signature, lender and inverter-monitoring services. Their terms apply to your use of them, and we are not responsible for them. Financing figures come from the lender; once a lender approves a payment, that is the figure shown.
6. Referral rewards
Referral and ambassador rewards are offered by the solar company, not by Hyperis Solar, under the company’s own program rules. A completed tax form may be required before a reward is paid.
7. Availability and changes
We work to keep the Services available and secure, but they are provided “as is” and may occasionally be unavailable for maintenance or reasons outside our control. We improve the Services over time and may change or retire features, with notice for material changes that affect subscribing companies.
8. Liability
To the extent the law allows, Hyperis Solar is not liable for indirect, incidental or consequential damages, and our total liability for any claim is limited to the amount paid for the Services in the twelve months before the claim.
9. Ending use
You can stop using the Services at any time. We may suspend access that breaks these terms or puts others at risk. Sections that by their nature should survive — such as data, liability and this section — survive.
